Could you amend the details on your page "Advocates and Solicitor Advocates in Scotland and Barristers in England, Wales and Northern Ireland" to change the details for the Ferguson stable to Ampersand?  The stable has undergone a re-branding exercise following staffing and member moves.

Our new external web address is: http://www.ampersandstable.com.  The site in is development and should go live later this month.  The old Ferguson Stable site will go down from then.

I checked the site and it really doesn't look as if you do any work outside England & Wales.  If you look at all the text at the bottom of the page, none of the towns or cities are in Scotland or Northern Ireland.  If you were doing work in Scotland, would you just subcontract this to a firm in Scotland?

Same as before.  Happy to add the links, but want to do so in the right place - can't see any reference to Scotland at all.  In relation to conveyancing, Scotland is very different to England - would your call centre know what a missive was or a standard security?

Please could you update the link you have to the Scottish Child Law Centre.  It is on your Law Centres page.  You have it down as link not working, but it should work if you link to www.sclc.org.uk.  It may be more useful for your users to list it under Family Law - Children and Young People rather than (or as well as) under Law Centres.

Could you update the references to Masons under Law Firms in Glasgow and Law Firms in Edinburgh to Pinsent Masons and update the link to the website of the firm to www.pinsentmasons.com as opposed www.masons.com.  This change follows a merger a few years back.

Also under Patent Agents in Scotland, Fitzpatricks and Kennedys are no longer seperate entities having merged into Murgitroyds. Also Cruikshank & Fairweather are now part of Marks & Clerk. Also could I suggest the title of the listing for Patent Agents be amended to be entitled 'Patent and Trade Mark Attorneys'. Not all Trade Mark Attorney firms are Patent Agents/Attorneys and add links to other Patent/Trade Mark Attorneys such as:-

Deed Poll isn't relevant for Scotland, is it?

From my family law lectures I seem to remember that you can legitimately change your name whenever you want just by telling people you've changed it, provided it isn't done for fraudulent reasons.  May be wrong though.

Will add the site for England tho, unless you think otherwise.

It is possible to change your name through usage but in order to have official records, such as a passport, changed into a new name, it is usually necessary to provide documentary evidence. A Deed Poll, whilst being an English legal document, is accepted throughout the UK including Scotland as documentary evidence of a change of name.

When the websites were first built, they only catered for England & Wales. Hence, the reason why only English and Welsh locations are listed. However, since then we have gone Nationwide. However, we have not yet got round to adding in the Scottish towns and cities to the Websites. That will be addressed shortly as the sites are about to be upgraded

We are fully aware of the differences between Scottish law and the law as it stands in England & Wales.

Grateful if you would add my site S3i Accident Investigations to the site, somewhere under the "services to the legal profession".  You don't seem to have a dedicated area for personal injury investigators, perhaps an area needs to be added?

Hi,

I'm Billy Middleton and was recently acquitted and released following over 5 1/2 month remanded in HMP Aberdeen. From the moment I first got there I realised that unless a person is in frequent contact with the law, there really is no way of deciding which lawyer is best to represent you. I was lucky and was represented by George Mathers but his selection was not based on what either myself or my family knew but simply good fortune.

I also found that there was no real support for my family who went through as much hell on the outside while I did likewise on the inside and there simply was no information provided as to where to look for it.

Since my release I have decided to channel my frustrations towards resolving these issues and have set up a site to help accused people and their families cope with what for almost all of them is the most stressful situation they have ever faced. The stress begins in ernest I feel when trying to make sure you or someone you love has the best possible defence so I am concentrating on this area at the moment. Therefore I am appealing for solicitors/lawers and the companies they work for to come forward with their information to be included in my database which I have specifically designed to make it easy for anyone looking to find the right one in their area.

I wondered if you would consider doing a piece in your magazine to that regard. www.wronglyaccusedperson.org.uk has attracted considerable attention despite only being live online for around 2 weeks so you can imagine the benefits to any firm contained in the search database. Either that or simply including the link would be great

I would be very grateful if you could look at the site and let me know if you could cover it in some way to assist my efforts in finding people the right help.

I was wondering if you would consider adding my website, 'www.scottishpropertylaw.com', to Scottish Law Online. It's a not-for-profit website designed to provide news and case reports to people with an interest in Scottish property law and practice. In many ways, it's more blog than website.

I suggest that you add http://www.foolkit.com.au to your Courts and Tribunals, Legislation and legal portals.

Foolkit is a legal toolkit that I originally wrote for my own law firm.  It proved so popular that there are now editions for the various States of Australia.  It also now has information for the public.

At present you have Austlii for the Courts.  This has the decisions of the Court.  Foolkit gives you the contact details of the Courts, their websites, Rules, Legislation, lists, barristers/advocates and more.

Austlli has an excellent collection of legislation and it is well marked up.  However, it is a secondary collection and not authoritative.  Foolkit links to the primary sources and cuts out multiple steps in accessing this.

With the law portals you have listed a news site for Australia.  Foolkit is a completely practical resource and the largest legal information website in Australia by variety and number of resources.  If a lawyer is looking for something about Australia and it's not in Foolkit - then it probably doesn't exist!

Hiya, I'm in desperate need to find a solicitor to take my case on a legal aid basis which is currently sitting in the Court of Session in Edinburgh.   I have raised a Cohabitation rights claim and though my plea in law was not sustained in the Sheriff court I have lodged grounds of appeal on inadmissible evidence being used which of course then formed the judge to base his decision on that evidence being led.  My late partner of 17 years died suddlenly without leaving a will and his parents have put claim to the property and locked me out, in a manner of speaking.  I would appreciate if anyone would be willing to help me I have approached a few solicitors but no one is willing to take my case on a legal aid basis.  Any help and advice would be appreciated as I feel my appeal is about to be disregarded as it is now deemed 'abandoned' as I did not get my appeal prints in on time though I had lodged a motion to sist on medical grounds which was refused and therefore the procedural timetable was not stopped and I ran out of time to lodge the prints.  I have now been informed that I can lodge a motion to repone against the 'deemed abandonment' and along with the appeal prints on 27/06/2011 but I'm not confident that this will be granted, i'm now not sure what I should now do with this case and wonder if I could now at this stage take the case to the supreme court in London. :'( Someone please help me for not only have I lost my life sole mate am now about to lose the case too.

One of the problems is that the rules about admissibility of evidence are different in civil cases and criminal cases. In a criminal case the rules are very strict if evidence is tainted whereas in civil cases often the court will admit evidence even if e.g. illegally obtained if it is relevant to the issue in the case. The first pont therefore is on what basis is the evidence inadmissible? It may be that the solicitors who have looked at the case are of the view that it will not succeed.
As for getting a lawyer on legal aid you can ask the Law Society as they will have a list of solicitors who undertake this kind of work.

Hiya, thanks for your're reply to my post.  I understand that civil and criminal 'inadmissible evidence', is considered and viewed differently, and I understand why that should be so.  However, for example in my case my solicitor (who only took my case four months before proof...and knew exactly the pleas in law and the defence of the case before she agreed to take the case) withdrew from acting for me two weeks before proof because I would not accept a tender of £25,000 (though she informed the legal aid board previously that we had a good prospect of success) she failed to cite any witnesses for me, though we knew proof had been set in at least 12 wks before her departure and knew my late partner's estate was worth approx £600.00.  When she withdrew from acting, I lodged a motion to 'discharge' as I had then no legal representative nor did I have any witnesses cited (although 18 were lodged as part of my productions).  This motion to discharge was not granted and therefore proof was deemed to go ahead 3 days later regardless of me being a party litigant and having no witnesses cited (this point I raised with the court at the motion hearing, stating the court was aware I had no witnesses cited as I would have had to process this through the court and give at least 28 days for the witnesses to organise the date to attend). I feel I did not get a fair hearing under the Humans Rights Act 1998 art 8.  In regard to the 'inadmissible evidence' being led, there was an Avidavit presented to the court on the first day of proof which was full of anomolies about myself and my late partner's relationship and cohabitation over the 17 yrs.  I opposed this late production being led but my opposition was disallowed.  I since found out that this was not an Avidavit, and this fact is now agreed by the defender's solicitor (for I contacted the witness in question) , and the defender's solicitor led 8 witnesses for his defence, whom I contradicted on most of their facts stated.  Most of this was inadmissible evidence and I have proof I lived with my partner and was in a relationship for more than 17 yrs.  During proof I was awarded cohabitation rights but there is no reference to this in the final judgement which took 4 mths to reach, and I have been informed should I request the shorthandwriter's transcript then I will have to put £3500.00 upfront for them to be extended.

The clux of this case lies in the fact that my late partner was buried without my knowledge.  I was working away from home  when he died and his father and step mother failed to informed me, even though they were receiving my distressed calls in trying to contact him.  They knew I had cohabitation rights and decided not to inform me of my late partner's death and put his place on the market even before I knew he had died.  Thankfully, it is not sold as yet as I still have rights over the property until it is deliberated through the court to the contrary.  I believe justice will prevail....eventually...!

Any help and advice would be appreciated.
