Attendance allowance issue

I am looking for a Scottish law expert in social security law to help me answer the following question:

Is there are legitimate basis in statute which means that a self-funding resident in a care home in Scotland must forfeit their entitlement to Attendance Allowance on receipt of free personal care payments from their local authority.

In an explanation to Help the Aged  the DWP have stated that the reason that self-funding residents are obliged to relinquish their entitlement attendance allowance payments due to the terms of Regulation 7 of the attendance allowance regulations 1991.
