It is my believe that this offence still remains on the statute books.

But, is it still referred to in court as this or simply attacking someone in their own home or own territory?

It was never on the statute books - it's a common law crime.  The last case of hamesucken that I can recall being referred to as such was in Lerwick in 1998 or 1999.  The essence of hamesucken is that the house is entered with the intention of assaulting an occupant.  Crown Office does not like old fashioned crimes like this and it is not a style charge on the Procurator Fiscal Service computer, which makes future prosecutions more or less impossible.  It would now be charged as an assault.

Well, I have just been the victim of hamesucken and the PF has charged the accused with exactly that. This offence is therefore allive and well.

Incidentally does anyone know the likely sentnece for hamesucking?

Hi there i am new to your forum,i have just been reading the courier (Dundee Edition)and there is a guy in court yesterday tuesday 14th feb for Hamesucken,he appeared in private (a sentence of up to 3 years and was fully commited 110 days remand unless the sentences have been increased)so Hamesucken is being used by the PF .

I've just interviewed an offender and note from his previous convictions that he was charged with Hamesucken at Glasgow Sheriff Court in 2008. This offence, together with 8 offences of housebreaking, attracted a sentence of 3 years.
