Moveable Estate in Scotland
Feb 1st, 2007 at 5:08pm

My wife took out a Life Insurance policy naming me as beneficiary. Following her death, will the policy proceeds be defined as part of her "Movable Estate"?

Thanks, Redser

Tehcnically, yes (insomuch as they are clearly not "Heritable Estate").  This having been said, as you are the beneficiary you will receive the proceeds (which I assume is the thrust of your question).

Thanks, Petrocelli. It will benefit me if it is not part of a "Moveable Estate". Will your answer allow me grounds for objecting to its inclusion?

Does that imply that the value of the policy payout is included in the letters of Confirmation ( Probate ) Surely this would not be declared as it is post or at DOD. The value of the policy can not form a part of two estates at the that time. Regards Peter
