Hiya, thanks for your're reply to my post.  I understand that civil and criminal 'inadmissible evidence', is considered and viewed differently, and I understand why that should be so.  However, for example in my case my solicitor (who only took my case four months before proof...and knew exactly the pleas in law and the defence of the case before she agreed to take the case) withdrew from acting for me two weeks before proof because I would not accept a tender of £25,000 (though she informed the legal aid board previously that we had a good prospect of success) she failed to cite any witnesses for me, though we knew proof had been set in at least 12 wks before her departure and knew my late partner's estate was worth approx £600.00.  When she withdrew from acting, I lodged a motion to 'discharge' as I had then no legal representative nor did I have any witnesses cited (although 18 were lodged as part of my productions).  This motion to discharge was not granted and therefore proof was deemed to go ahead 3 days later regardless of me being a party litigant and having no witnesses cited (this point I raised with the court at the motion hearing, stating the court was aware I had no witnesses cited as I would have had to process this through the court and give at least 28 days for the witnesses to organise the date to attend). I feel I did not get a fair hearing under the Humans Rights Act 1998 art 8.  In regard to the 'inadmissible evidence' being led, there was an Avidavit presented to the court on the first day of proof which was full of anomolies about myself and my late partner's relationship and cohabitation over the 17 yrs.  I opposed this late production being led but my opposition was disallowed.  I since found out that this was not an Avidavit, and this fact is now agreed by the defender's solicitor (for I contacted the witness in question) , and the defender's solicitor led 8 witnesses for his defence, whom I contradicted on most of their facts stated.  Most of this was inadmissible evidence and I have proof I lived with my partner and was in a relationship for more than 17 yrs.  During proof I was awarded cohabitation rights but there is no reference to this in the final judgement which took 4 mths to reach, and I have been informed should I request the shorthandwriter's transcript then I will have to put £3500.00 upfront for them to be extended.

The clux of this case lies in the fact that my late partner was buried without my knowledge.  I was working away from home  when he died and his father and step mother failed to informed me, even though they were receiving my distressed calls in trying to contact him.  They knew I had cohabitation rights and decided not to inform me of my late partner's death and put his place on the market even before I knew he had died.  Thankfully, it is not sold as yet as I still have rights over the property until it is deliberated through the court to the contrary.  I believe justice will prevail....eventually...!

Any help and advice would be appreciated.
