Lawyers Letter.

Hi,

We have received a letter from a lawyer threatening to go to court to obtain an interdict because of intimidating behavior and harassment. All fairly straightforward you would think but the problem is the person making the allegations is the person who made the first contact and we simply replied stating we did not wish to have contact with them.

My question is, what steps should a lawyer take to ensure that the facts they are acting on are correct or do they they just send threatening letters out on the say so of a client?

I will add this is part of an ongoing problem with this person and their lawyer in that this is not the fist time we have been here. But I think it is time to do something about the situation.

The answer to your queston is that the solicitor sends this kind of letter on behalf of the client - see recent case about a complaint by someone on the receiving end
