Where the Crown does not libel an aggravation (racial, religious, prejudice, homophobia ect) and where evidence is given, that the motivation for the crime was wholly or partly due to such beliefs, can a verdict with the aggravation be returned by the jury?
Also, would it be possible for a Crown motion to amend the charge,to include the aggravation, prior to the determination of the case?
