Forced sale query
Dec 29th, 2012 at 6:03pm
My mother died three years ago, her house having previously been transferred into the joint names of myself and my brother. We also both inherited a sum of money.

I used my full inheritance to have the property renovated and brought up to current standards, my brother did not put any money towards this.

As I have my own property and he was living in a one bedroom housing association property with his wife and stepdaughter I agreed to let him move into the jointly owned property and to stay there for around 10 years but no legal agreement was put in place.

I am now concerned that he is not looking after the property properly and since I had a bit of a go at him about these concerns he has taken the huff and ceased to communicate with me.

I now wish to know how I stand legally if I wish the property to be put on the market and whether I can force a sale. Hopefully we can resolve our differences without going to such lengths but I feel that I have to address the legal issues immediately. As far as I am aware my brother is still paying rent and a 25% mortgage on his housing association property which is up for sale but not attracting interest. I would also like to retrieve the funds I spent on the renovation but realise that I may have to write this off.

I would be most grateful for any advice received.
