Title: Contract - Breach and Remedies
Post by mightypine on Mar 3rd, 2004 at 10:18pm
Would a company be able to end their contract immediatel with a company if:

A company agrees adeal with a bus company to put 15 posters up on their buses but within a month a representative of the company goes to the bus HQ and discovers that only 12 of the buses have posters on them, the executive for the bus company said that they had run out of paste and were waiting on a delivery.  In order to get out of the contract either company has to give 6 months notice.

WOuld the company be able to withdraw from the contract immediately?

would this be a breach of contact? and if so is it a material breach and what would be the remedies?

Sounds familiar, I'm studying in Dundee and have a similar courework. Sounds like defective performance, if you want to exchange info just mail me.

If anyone could suggest a few similar cases i'd be much appreciative.

I really can't remember the case, but it'll be in thomson.  i'm just going to say i think there's a case to do with adverts on a council's bins and breach of contract which is relevant to your question.  fantastically unhelpful, i know, sorry.  if you can remember the name of the case, let me know.

Hello
Am wondering if you can help me with an example problem i have just been given. i have only just started principles of private law so am used to it all.
The problem is:
When charles and diana became engaged charles gave diana an engagement ring. The ring however belonged to charles grandmother and he told diana that whatever happened he wanted diana to have the ring. Diana has lost the ring however, but it was found by andrew who has given it to his girlfriend sarah. Diana has seen sarah wearing the ring.
Charles and diana also bought a house together to move into when they get married, where meanwhile they are storing their wedding presents. Returning from business abroad diana finds a contractor working in her living room. Charles has hired him to strip  back the walls. Diana tells the contractor to stop work immediately. He refuses.
The wedding is the abandoned. Diana wants to get rid of her share of the house and is livid when Charles sends her the bill for the work of the contractor on the house.
Advise Diana, Charles and Sarah fully.
