non conviction police information
Aug 20th, 2006 at 3:39pm

anyone know in relation to child access case, if a parent is concerned about  drug use involvment by the other partner but has no concrete evidence can the court be asked to check with police if they have any non conviction information. common knowledge locally he is at it/but that amounts to no more than gossip i suppose in court. he may have had police input for cannibas but again gossip tells us its much much more than that.
thanks

We have a similar situation with my partner's ex husband.  He's a convicted sex offender and has several convictions for drug use and supply.  We told our solicitor about this but she told us it wasn't relevant as he had "parental rights".  The issue of his convictions were never raised in court and despite numerous child welfare hearings, it's  still never been mentioned.

Futher to this, we're not allowed to mention this to the school his youngest daughter attends.  Despite previously being banned from going near a school, a Sheriff recently ordered that he can no collect his daughter from school which seemingly over-rides any order made previously.

It's absolutely disgusting.  Yet, we've been informed that if we live in England or Wales, the law is different in this respect.
